Unmarried Woman Wins Pension Battle  

Julie Byers Solicitor has already taken several calls this week following a landmark judgment from the Supreme Court in relation to pension rights of unmarried and cohabiting couples.

On Judicial Review the Supreme Court has ruled that an unmarried woman was discriminated against when her partner’s public sector pension scheme refused to pay her survivor’s benefits. The Court declared that there was unlawful discrimination on the grounds of marital status.

As one in six families in the UK are cohabiting, there could be significant implications for millions of families. Those implications may not be limited solely to pension rights.
